TERMS AND CONDITIONS
FOR JOB POSTING AND RECRUITMENT SERVICES

These Terms and Conditions for job posting and recruitment services (“Terms”) are an integral part of the Terms of Services made by Search Remotely, with its principal place of business at 19 Wellington Street, Bondi, NSW, 2026, Australia (“Search Remotely”, “we”, “us”, “our”).
These Terms shall govern our service on job posting with recruitment option available on the website https://searchremotely.com (the “Website”) under the terms and conditions provided below. Please note: these Terms and Conditions for job posting and recruitment services for free do not apply to free internship roles and jobs without any payment for employee. If you want to post a job without any payment for employee, please select one of our paid services at https://searchremotely.com/post-a-job/.
These Terms are the binding legal agreement between Search Remotely and customers (“Customer” or “you”) posting a paid job offer for free in return of recruitment services.
These Terms are the integral part of the Terms of Services which can be accessed at https://searchremotely.com/terms-and-conditions/. By posting a job on the Website, the Customer agrees to be bound by these Terms and the Terms of Services. Please read these documents carefully.
1. Customer’s Eligibility
1.1 This Website can be used by individuals and legal entities subject to their compliance with these Terms and applicable law. To be eligible to post a job on the Website, you must be at least eighteen (18) years old and be able to form legally binding contracts. If you act on behalf of a legal entity, you represent and warrant that: (a) the legal entity that you act on behalf of is a legal entity duly organized and is validly existing under the applicable laws of its jurisdiction; and (b) you have all necessary approvals and permissions to act on behalf of such legal entity.
1.2 When posting a job on the Website, the Customer represents and warrants that it has full power to enter into and perform its obligations under these Terms.
2. Free Job Posting and Recruitment Services
2.1 On the Website Customers can post a job as a paid service which is governed by the Customer’s Terms and Conditions or for free which is governed by these Terms. The job posting as a free service is available to all Customers subject to their consent to enter into a recruitment agreement in accordance to which Search Remotely will provide recruitment services for a fee if the customer decides to hire our candidate. The recruitment service includes searching, screening and interviewing candidates. The search will be conducted within the list of available candidates registered on the Website and/or on authorized third party sources. Successful candidates will be transferred to the Customer for further interviewing and consideration.
2.2 The Customer agrees to pay a recruitment fee at the time of hiring our candidate to Search Remotely in the amount of:
– 15% of the total annual salary for permanent roles (including employment), to be paid as a one-off fee to Search Remotely.
– 15% of the total independent contractor remuneration for contract roles to be paid as a monthly fee each month to Search Remotely. Or if preferred by the client, Search Remotely will endeavour to find someone within the client budget whilst including our fee within that amount.
2.3 The recruitment fee to Search Remotely shall be paid upon a start date of the contract with the successful candidate to be paid by the Customer to Search Remotely’s designated bank account.
2.4 The Customer may post an unlimited number of jobs on the Website if the Customer opts for a free service in return of recruitment option.
2.5 Each job posting will be available on the Website for maximum 60 days unless the job posting is terminated by the Customer by email notice or manually on the Website.
2.6 For candidates with permanent roles contracted through the Website, Search Remotely undertakes to replace the candidate without any additional fee during 30 days warranty period if the candidate fails to pass a probation period or quit during this term, unless otherwise indicated by Search Remotely. The replacement shall be requested by the Customer within 30 days from the termination date of contract with employee.
2.7 For candidates contracted through the Website as independent contractors, Search Remotely provides no guarantee or refund.
2.8 Search Remotely reserves the right to refuse to post any job for any reason.
2.9 This Website does not constitute and shall not be regarded as a recommendation or endorsement of the quality, service level, qualification of job offer, job description or other content displayed on the Website. In no event will Search Remotely or its employees, agents, contractors, partners, directors be liable for any punitive, special, incidental or consequential damages including, without limitation, loss of business, revenue, profits, use, data or other economic advantage, in connection with or arising out of these Terms.
2.10 When using the Website, the Customer agrees not to engage in any act or omission, that directly and/or indirectly constitutes or may directly and/or indirectly constitute:
- a breach of any applicable laws and/or regulations;
- posting jobs and other content that is hateful, threatening, pornographic, unethical, religious, incites violence, or contains graphic and/or gratuitous violence;
- posting any content that violates any intellectual property rights, including copyright, trademark and other proprietary rights.
3.1 These Terms supplement the general Terms of Services. All other provisions of the Terms of Services remain applicable to the Customer.
